This store is operated by COMANI ACADEMY PTY LTD (ABN 17 700 391 457) of Melbourne, VIC, Australia, trading as CHALKED. By visiting this store or placing an order you agree to these Terms of Service. Please read them before you buy.

1. Using this store

You must be at least 18 years old, or the age of majority where you live, to place an order. You agree not to use the store for any unlawful purpose, not to interfere with its operation or security, and not to copy, scrape or resell any part of it without our written permission.

2. Products, pricing and availability

All prices are in US dollars and include free standard shipping to the United States. We do our best to describe products and show colours accurately, but screens vary and minor differences in shade, finish or dimensions are not a defect. We may change prices, products and offers at any time without notice, and we may limit quantities or discontinue a product. We reserve the right to refuse or cancel any order, including where we suspect fraud, reseller activity, an obvious pricing error or abuse of our guarantee. If we cancel an order you have already paid for, we refund you in full.

3. Orders and payment

Your order is an offer to buy. It is accepted when we send you a confirmation email. You agree to provide accurate, current and complete purchase information. Payment is taken at checkout through our payment providers, and your card details are handled by them and not by us.

4. Shipping, returns and refunds

Delivery timeframes are set out in our Shipping Policy. Refunds and our 30-Day Grip Guarantee are set out in our Refund Policy. Both form part of these terms.

5. Safe use of training equipment

Our products are training accessories, not medical devices or safety equipment. They do not prevent injury and they do not make any lift safe. Use them with correct technique and within your ability. Check any product for wear before each session and stop using it if it is damaged. Training carries a risk of injury. Speak to a doctor before starting or changing a training programme, particularly if you have an existing injury or condition. You accept that you use our products at your own risk.

6. Intellectual property

The CHALKED name, logo, product photography, page copy, videos and designs are owned by us or used under licence, and are protected by copyright and trade mark law. You may not reproduce or use them commercially without our written permission.

7. Reviews and submissions

If you send us a review, photo, video, comment or idea, you grant us a non-exclusive, royalty free, worldwide licence to use, edit and publish it in connection with our products and marketing, without payment or attribution. You confirm the content is yours to give, that it is honest, and that it does not breach anyone else's rights. We may edit for length or remove content that is abusive, misleading or unlawful. We are not obliged to keep any submission confidential.

8. Third party links and services

The store may link to third party sites or use third party services. We do not control them and we are not responsible for their content, products or privacy practices. Any dealing with a third party is between you and them.

9. Disclaimer and limitation of liability

Except where the law says otherwise, the store and our products are provided on an "as is" and "as available" basis without warranties of any kind. We do not warrant that the store will be uninterrupted or error free. To the maximum extent permitted by law, our total liability to you for any claim connected with an order is limited to the amount you paid for that order, and we are not liable for indirect, incidental or consequential loss, including loss of profit or loss of training time.

10. Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where our liability can be limited, it is limited at our option to replacing the goods, supplying equivalent goods, or paying the cost of doing either.

11. Indemnity

You agree to indemnify us against any claim, loss or expense arising from your breach of these terms or your misuse of our products or the store.

12. Errors and inaccuracies

Occasionally there may be information on the store containing typographical errors or inaccuracies relating to product descriptions, pricing, promotions, offers or availability. We may correct any error and change or update information at any time without notice, including after you have submitted an order.

13. Termination

We may refuse service or terminate your access to the store at any time for breach of these terms. Obligations incurred before termination survive it.

14. Governing law

These terms are governed by the laws of the State of Victoria, Australia, and you agree to the non-exclusive jurisdiction of the courts of that state. This does not remove any protection available to you under the mandatory consumer laws of the country or state where you live.

15. Changes to these terms

We may update these terms at any time by posting a revised version on this page. The date at the top shows when they were last changed. Continuing to use the store after a change means you accept it.
